Understanding Domestic Violence Charges

"Domestic violence" is a specific legal term in Arizona. By statute, a crime can be considered one of domestic violence if it is committed between parties who are related by marriage, former marriage, or reside in the same household. In addition, the offense may be considered one of domestic violence if the parties involved have children in common, or have a child on the way. If the victim is a child, grandchild, parent, or grandparent of the accused, the offense may be considered one of domestic violence.

Consequences of Domestic Violence Charges

Domestic violence charges can have severe consequences, including both criminal charges and civil actions which can deny normal rights to the accused.

If any noticeable injury or damage to property has occurred, the police must arrest someone. Depending on the court, bail bonds to remain out of custody can be extremely high. Normally, even if released, returning home is not an option. In addition to the criminal case, the injured party will often request an Order for Protection. This is a separate, civil, issue that must be addressed in a court other than the criminal court. And, if you violate the Order for Protection by returning home, sending a card or letter, or even making a telephone call, you can be charged with additional criminal offenses. If you are convicted of any domestic violence offense, counseling is mandatory. Your constitutional right to vote and right to possess firearms may be taken away.
